These Terms and Conditions govern the provision of travel services by Open Sky Travel (“we”, “us”, “our”) and apply to all customers (“you”, “your”) who make enquiries, bookings, or use our website. By using our website or booking travel services through Open Sky Travel, you agree to be bound by these Terms and Conditions.

1. Our Role as a Travel Agent

Open Sky Travel acts as an agent for third-party travel service providers, including airlines, accommodation providers, tour operators, cruise lines, and transport providers (“Suppliers”). Your contract for travel services is directly with the Supplier, and their terms and conditions apply in addition to these Terms and Conditions.

2. Accuracy of Information

We take reasonable care to ensure that information provided to you is accurate at the time of booking. However, we rely on information supplied by third parties and cannot guarantee that all details will be free from errors or changes. Prices, availability, itineraries, and conditions may change until bookings are confirmed and paid in full.

3. Quotes and Pricing

  • All prices are quoted in Australian dollars (AUD) unless otherwise stated.
  • Prices are subject to availability and may change due to factors outside our control, including supplier price changes, currency fluctuations, taxes, and fuel surcharges.
  • A booking is not confirmed until full payment (or deposit, where applicable) has been received and confirmation issued.

4. Payments

  • Payment methods accepted will be advised at the time of booking.
  • You authorise Open Sky Travel to process payments on your behalf to relevant Suppliers.
  • Some Suppliers may require full payment at the time of booking. Credit card surcharges may apply and will be disclosed prior to payment.

5. Deposits and Final Payment

  • Deposits may be required to secure bookings.
  • Final payment deadlines are determined by Suppliers and are strictly enforced.
  • Failure to make payment by the due date may result in cancellation and loss of monies paid.

6. Cancellations and Changes by You

  • Cancellations and changes are subject to the terms and conditions of each Supplier.
  • Fees, penalties, or loss of payments may apply.
  • Open Sky Travel may charge a reasonable service fee for changes or cancellations. We recommend you carefully review all Supplier conditions before confirming your booking.

7. Cancellations and Changes by Suppliers

Suppliers may cancel or change services for reasons beyond our control, including operational requirements, weather, or force majeure events. Where this occurs, your rights and remedies will be governed by the Supplier’s terms and applicable Australian Consumer Law.

8. Refunds

  • Refunds are subject to Supplier approval and conditions.
  • Open Sky Travel cannot guarantee that any refund will be issued.
  • Service fees charged by Open Sky Travel are generally non-refundable, unless required by law.

9. Travel Insurance

We strongly recommend that you obtain comprehensive travel insurance at the time of booking, covering cancellation, medical expenses, delays, loss of luggage, and other unforeseen circumstances. Failure to obtain travel insurance is at your own risk.

10. Passports, Visas, and Health Requirements

  • Hold a valid passport with sufficient validity
  • Obtain all required visas, permits, and re-entry documentation
  • Meet health, vaccination, and entry requirements of your destination(s)

Open Sky Travel accepts no responsibility for issues arising from failure to meet these requirements.

11. Special Requirements

Please advise us of any special requirements (including medical conditions, mobility needs, or dietary requirements) at the time of booking. While we will pass these requests on to Suppliers, we cannot guarantee that they will be met.

12. Liability

To the extent permitted by law:

  • Open Sky Travel is not liable for acts, omissions, or defaults of Suppliers.
  • We are not responsible for loss, damage, delay, injury, illness, or death arising from services provided by Suppliers.
Nothing in these Terms and Conditions excludes or limits rights you may have under the Australian Consumer Law (ACL).

13. Force Majeure

Open Sky Travel is not responsible for any failure or delay in providing services due to events beyond our reasonable control, including natural disasters, pandemics, strikes, government actions, or airline disruptions.

14. Website Use

You agree not to misuse our website, including attempting unauthorised access, introducing malicious code, or using content for commercial purposes without permission. All content on this website is owned by or licensed to Open Sky Travel and is protected by intellectual property laws.

15. Privacy

Your personal information is handled in accordance with our Privacy Policy, which is available on our website and forms part of these Terms and Conditions.

16. Governing Law

These Terms and Conditions are governed by the laws of South Australia, and you submit to the exclusive jurisdiction of the courts of South Australia.

17. Amendments

We may update these Terms and Conditions from time to time. The latest version will always be available on our website.
